Arbitration Law in Oman: Key Legal Framework

Oman’s arbitration system is governed by Royal Decree 47/1997 (amended by Royal Decree 3/2007), based on the UNCITRAL Model Law, ensuring compliance with global standards.

  • Institutions: Oman Commercial Arbitration Centre (OCAC), ICC, and ad hoc forums.
  • Governing Law: Parties choose applicable laws unless conflicting with Shariah, public policy, or mandatory Omani law.

Oman Commercial Arbitration Centre (OCAC)

Established under Royal Decree 26/2018, OCAC offers a modern institutional platform for commercial arbitration in Oman, providing procedural rules and administrative support for efficient dispute resolution. We regularly assist clients with OCAC-administered disputes as well as ICC, LCIA, and UNCITRAL arbitrations.

Legal Grounds to Challenge or Nullify an Award

Arbitral awards are final and generally not appealable, but may be nullified on limited grounds such as:

  • No valid arbitration agreement
  • Lack of party capacity or due process violations
  • Arbitrators exceeding authority
  • Violation of public order
  • Procedural irregularities

Challenges must be filed within 90 days of the award notification.

Enforcement of Domestic and Foreign Awards

  • Domestic awards are enforceable after the 90-day nullification period, deposit with the court, and fulfillment of procedural conditions (including Arabic translation if required).
  • Foreign awards are enforceable under the New York Convention and GCC conventions, subject to compliance with enforcement standards.
